1. Acceptance of Terms
By accessing and using Kevingenus (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service.
2. Use License
Permission is granted to temporarily download one copy of the materials (information or software) on Kevingenus for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- Modify or copy the materials
- Use the materials for any commercial purpose or for any public display
- Attempt to reverse engineer any software contained on the Platform
- Remove any copyright or other proprietary notations from the materials
- Transfer the materials to another person or "mirror" the materials on any other server
- Engage in any data mining, data harvesting, or automated scraping
3. Account Registration & Responsibility
3.1 Account Creation
You may register for an account on Kevingenus by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account.
3.2 Age Requirement
You must be at least 13 years old to create an account on Kevingenus. By creating an account, you represent and warrant that you are at least 13 years old.
3.3 Account Termination
We reserve the right to disable any account or remove any content at any time if we determine that it violates these Terms or any applicable law.
3.4 OAuth Authentication
You may authenticate using third-party services such as Google OAuth. By using these services, you acknowledge that you have read and agree to the terms of service of those third-party providers.
4. User Content & Rights
4.1 Content Ownership
You retain all ownership rights to any content you create, upload, or publish on Kevingenus ("User Content"). You grant Kevingenus a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to:
- Host, display, and distribute your User Content
- Create backups and copies for technical and operational purposes
- Modify and adapt your content for technical compatibility
- Promote your content with attribution
4.2 Content Restrictions
You agree not to upload, post, or publish any User Content that:
- Infringes on any intellectual property rights
- Contains illegal content or promotes illegal activity
- Contains hate speech, violence, or discrimination
- Contains explicit sexual content
- Harasses, bullies, or defames any person or entity
- Constitutes spam, phishing, or malware
- Violates anyone's privacy rights
- Is fraudulent or misleading
4.3 Removal of Content
We have the right to remove any User Content that violates these Terms. We may also remove content if we receive valid legal notice (including DMCA takedown requests). Users will be notified when content is removed.
4.4 Your Responsibility
You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights and permissions to publish your User Content and that it does not violate any laws or third-party rights.
5. Intellectual Property Rights
5.1 Platform IP
All materials on Kevingenus not constituting User Content, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and data compilations, are the property of Kevingenus or its content suppliers and are protected by international copyright laws.
5.2 Limited License
We grant you a limited license to access and use these materials for personal, non-commercial purposes only. Commercial exploitation of the Platform materials without permission is prohibited.
6. Analytics & Data Tracking
6.1 View Tracking
Kevingenus automatically tracks the following information about story views:
- Number of views per story
- Time spent reading each story
- Completion status (whether a reader reached 50% of the story)
- Approximate reader location (country/region level only)
6.2 Use of Data
This data is used to:
- Provide authors with analytics about their content performance
- Improve the Platform's functionality
- Show you relevant stories based on your reading history
- Generate aggregate, non-identifying statistics
6.3 Privacy
All tracking data is handled according to our Privacy Policy. Individual reader information is never shared with content creators.
7. Newsletter & Communications
7.1 Newsletter Subscriptions
By subscribing to our newsletter, you consent to receive periodic emails about stories and content updates.
7.2 Opt-Out
You may unsubscribe from our newsletter at any time by clicking the unsubscribe link in any email or visiting your preferences page.
7.3 CAN-SPAM Compliance
We comply with all applicable email marketing regulations including CAN-SPAM Act requirements.
8. Disclaimer of Warranties
The materials on Kevingenus are provided on an 'as-is' basis. Kevingenus makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
9. Limitations of Liability
In no event shall Kevingenus or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Kevingenus, even if Kevingenus or a Kevingenus authorized representative has been notified orally or in writing of the possibility of such damage.
10. Accuracy of Materials
The materials appearing on Kevingenus could include technical, typographical, or photographic errors. Kevingenus does not warrant that any of the materials on the Platform are accurate, complete, or current. Kevingenus may make changes to the materials contained on the Platform at any time without notice.
11. Materials & User Content Disclaimer
Kevingenus does not endorse, guarantee the accuracy of, or assume responsibility for any User Content posted on the Platform. We are not responsible for:
- The accuracy, authenticity, or legality of User Content
- Any harm caused by User Content
- Any technical issues or errors
- Loss of access to your content
12. Limitation of Liability
In no case shall Kevingenus, its directors, officers, employees, agents, or suppliers be liable to you or any third party for any indirect, special, punitive, incidental, or consequential damages arising from your use of the Platform or inability to use the Platform, even if we have been advised of the possibility of such damages.
Our total liability in any matter arising under these terms shall not exceed $100 USD.
13. Indemnification
You agree to indemnify, defend, and hold harmless Kevingenus and its officers, directors, employees, and agents from any and all claims, damages, losses, and expenses (including attorney's fees) arising from:
- Your violation of these Terms
- Your use of the Platform
- Your User Content
- Your violation of any law or infringement of any rights of any third party
14. Termination
14.1 By Us
We may terminate or suspend access to your account immediately, without prior notice or liability, for any reason whatsoever, including violation of these Terms, illegal activity or content, fraudulent behavior, or repeated violations despite warnings.
14.2 By You
You may delete your account at any time through your account settings. Upon deletion, your account will be deactivated, but we may retain backups and copies for a reasonable period.
14.3 Effect of Termination
Upon termination, your right to use the Platform ceases immediately. Published content may remain visible unless you choose to delete it, subject to our backup policies.
15. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify users via email or by prominent notice on the Platform. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.
16. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
